I was still meditating on what arbitration actually is and means when I went to the launch of the 23rd edition of Russell on Arbitration recently. The answer is contained in this excellent new version of Russell's work which was completely re-written a while ago to reflect the importance and developing significance of arbitration which Julian Lew QC concludes may be the result of the momentum of the alternative dispute resolution movement which has resulted in decreasing numbers of cases being taken to the courts. Lew is right, of course - the nature of arbitration means that numbers are not available and are probably impossible to obtain because of the nature of this facility. Today, there are many different kinds of arbitrations used by parties from different industries, involving arbitrators with wide professional experience covering factual rather than legal issues. Russell on Arbitration is a masterly overview of English arbitration at work both at home and abroad and admired as such by many lawyers and lay people. For over 150 years, Russell has been the principal authority and guiding light for practitioners. Sutton, Gill & Gearing, following the original book precedent now bring readers what Judith Gill described to me as the practical approach to the arbitration process, including all the most recent arbitration cases and an examination of the key pieces of legislation.
